id=\"viewer-c6c2q\">O adicional de periculosidade \u00e9 um valor equivalente a 30% do seu sal\u00e1rio base, pago pela empresa ao trabalhador quando este\u00a0<strong>exerce atividade perigosa<\/strong>, que gera amea\u00e7a ou perigo a sua integridade f\u00edsica.<\/p><p id=\"viewer-1rvj6\">Apesar de, notadamente, a pr\u00f3pria dire\u00e7\u00e3o ser perigosa, uma vez que apenas no ano de 2021, as estradas federais registraram mais de 64 mil acidentes, sendo que destes, 5391 mortes foram ocasionadas, o direito brasileiro, infelizmente, n\u00e3o considera o mero ato de dirigir como atividade perigosa.<\/p><p id=\"viewer-a1rvm\">Entretanto, existem algumas\u00a0<strong>circunst\u00e2ncias que fazem o adicional de periculosidade ser devido ao caminhoneiro<\/strong>.<\/p><p periculosidade<\/strong>.<\/p><p id=\"viewer-cqtlu\">O artigo 193 da Consolida\u00e7\u00e3o das Leis Trabalhistas determina que \u00e9 devido o adicional de periculosidade ao trabalhador que fica em exposi\u00e7\u00e3o cont\u00ednua, mesmo que de forma intermitente a determinados materiais.<\/p><p id=\"viewer-89qoe\">Significa que essa exposi\u00e7\u00e3o n\u00e3o pode ser eventual, uma vez ou outra, mas tamb\u00e9m n\u00e3o existe necessidade de ser toda a\u00a0<a href=\"https:\/\/laquilaadvogados.com\/2022\/10\/25\/jornada-de-trabalho-do-caminhoneiro\/\" target=\"_top\" rel=\"noopener noreferrer\" data-hook=\"linkViewer\"><u>jornada de trabalho<\/u><\/a>\u00a0para configurar o direito.<\/p><p id=\"viewer-6h7mi\">Segundo o mesmo artigo, s\u00e3o esses:<\/p><ol><li><strong>Materiais explosivos.<\/strong><\/li><li><strong>Materiais inflam\u00e1veis.<\/strong><\/li><li><strong>Energia el\u00e9trica.<\/strong><\/li><li><strong>Transporte ou vigil\u00e2ncia de valores.<\/strong><\/li><\/ol><p id=\"viewer-dss93\">Assim, pela an\u00e1lise do dispositivo, temos que se voc\u00ea, amigo e amiga caminhoneiro, transporta carga explosiva, inflam\u00e1vel ou valores, especialmente no caso de precisar de escolta para acompanhar sua viagem, merece receber da empresa o\u00a0<strong>adicional de 30% referente \u00e0 periculosidade<\/strong>.<\/p><p id=\"viewer-a7ovr\">Al\u00e9m disso, caso voc\u00ea mesmo\u00a0<strong>abaste\u00e7a seu caminh\u00e3o<\/strong>\u00a0em postos de combust\u00edveis, n\u00e3o conte com aux\u00edlio de frentista, ve\u00edculos por determina\u00e7\u00e3o das empresas por duas raz\u00f5es: a primeira, para evitar que esse motorista fa\u00e7a mais paradas em postos para abastecer os ve\u00edculos e a segunda, \u00e9 que muitas vezes as empresas, a depender do volume de combust\u00edvel adquirido, conseguem pagar um valor menor por litro.<\/p><p id=\"viewer-c9dil\">Mas voc\u00ea sabia que ter um\u00a0<strong>tanque suplementar no seu caminh\u00e3o<\/strong>\u00a0tamb\u00e9m lhe d\u00e1 direito ao\u00a0<strong>adicional de periculosidade<\/strong>?<\/p><p id=\"viewer-ubfv\">Em maio de 2022, o Tribunal Superior do Trabalho aplicou o entendimento da SBDI-1 e da Norma Regulamentadora n\u00ba 16, determinando que um caminhoneiro que utilizava\u00a0<strong>tanque
